Analysis Unit 7 Essay

After nineteen years working as a plant maintenance engineer, employee Bob Thomas was terminated after Jean Lipski the Human Resources Director discovered that Bob was involved in starting a union at the Apollo Corporation. This case will answer the questions: 1. what, if any violation of the law did Apollo Corporation commit? 2. What may be the arguments that Jean Lipski and Bob Thomas use to defend their cases? The case study will also briefly list things mangers should not do to commit unfair labor practices. Review/Analysis of the Case Apollo Corporation is a company that makes component parts for the communication industry. Bob Thomas a Plant Maintenance engineer worked for the company for nineteen years. During the previous five years of his employment his attendance was insufficient, he was a complainer, and also was reported as being a troublemaker. The Apollo Corporation had a laid-back type of atmosphere. As a result of the companies not enforcing the policies strictly and applying disciplinary action against employees not conforming to company policy and a failure to comply with such polices were never put to use (Bohlander 2007). Apollo Corporation is involved in highly competitive industry to produce; HR Director Jean Lipski met with the managers during several meetings and instructed them to exercise their supervisory relationship employees. The employees that did not adhere to HR policies would have disciplinary action against them. Bob and several of the employees were not happy of hearing about the enforcement of the policies. Bob also began to worry about his job, because his attendance was so poor and being labeled as troublemaker and complainer. So Bob contacted the union organizer of the Brotherhood of Machine Engineers. Bob conveyed to the union organizer that he wanted to start a union drive in the company. After a week went by fliers were handed out to the employees about a union meeting. Jean Lipski found out that employees were putting together a meeting to discuss being a union and Bob was the leader of the campaign, Jean called Bob Thomas into her office and terminated his employment with company on the basis of his unsatisfactory work performance and less than perfect attendance. Bob immediately called the union organizer and informed him of his discharge from The Apollo Corporation. Bob and the union organizer immediately headed to the regional office of the NLRB to file unfair labor practice charge against The Apollo Corporation for involvement to unionize the company. Analysis of Findings Apollo Corporation could be charged with unfair labor practices of the National Labor Relations Board (Belcourt, 2004). The National Labor Relations Act, section 7 states â€Å"employees have the right to self-organization, to form, join or assist labor organization. †(p597) Bob Thomas termination happened shortly after he contacted a union organizer and started an campaign for a meeting to be held so that the employees could become unionized Jean Lipski arguments could be based off the fact that Bob had a record of poor attendance and unsatisfactory performance on the job and that was reason for his dismissal. Jean also could argue that she had conducted meetings with the managers to enforce the performance polices and that they were already being set in place and the fact that Bob contacted a union organizer was only to secure his job, because of his lack of performance. Bob Thomas could argue that he was discharged for his involvement in trying to unionize the company. Bob could point out the fact that The Apollo Corporation had been lax in their disciplinary practices in the past and he never suffered any repercussions for his poor performance, until he contacted a union organizer. He could further argue that his termination after contacting an organizer is a violation of the employee right to organize. Recommendations In order for this type of case to never happen again managers need to be aware of the unfair labor practices. Managers should not hire, promote or terminate employees on the basis of their union membership or gender, race and even religion (Belcourt 2004). Meetings should be held with both managers and employees. Most important, disciplinary policies should be enforced from the beginning of employment. Summary and Conclusions . This case study showed how an employee and a company not following their company policies from the beginning of employment can turn into a legal conflict involving the union. Employers have to practice fair labor and be knowledgeable of union practices in order to protect themselves from being accused or sued for discrimination.

Othello, the Moor of Venice

Iago (Othellos ensign) uses love against Othello (general of the Venetian army) to cause him to experience jealousy. He not only utilizes the Moors love for Desdemona, but also his love for Iago and their friendship My lord, you know I love you(1. 3. 117) Funny enough, Iago gives warning to Othello of the very negative emotion that he hopes to inflict upon him! No, sure, I cannot think it, that would steal away so guilty-like, seeing you coming. He continues his manipulating of his friend (3. 3. 95). Iago: Did Michael Cassio, when you wood my lady, know of your love Othello: He did, from first too last: why dost thou ask Iago: But for a satisfaction of my thought; no further harm. Othello: Why of thy thought, Iago Iago: I did not think he had been aquatinted with her. Othello: O, yes; and went between us very oft. See how he makes it almost seem as though Othello discovered this out on his own and Iago seems as a mere friend when the find is made. Iagos true nature is seen at this point. Iago refers to himself as a devil, but to say that he is bad because he is bad doesnt explain why he is repeatedly explains himself to himself. Your honest friend is one who is always there for you and who will always tell you the truth. Iago has a reputation for honesty and uses it for dishonest purposes. His nature is ugly in the way that compares others to animals, especially when referring to their sexuality. Othello is a military man who is often looked at with respect in this category. However, when taken away from the military eye where he offers so much safety, he is constantly mentioned by his color in a degrading way. Brabantio, Desdemonas father uses Moor as a derogatory name for Othello, but Othello is called other things, including my lord and general.. After the first two scenes of the play, Othellos color is rarely mentioned, so we may forget that when the play is seen Othellos blackness always makes him different from everyone else. Reference to him as the Moor emphasized that difference, but it is emphasized in other ways, as well. He is strong and firm in character but also has a loving side where Desdemona ( Othellos wife, Brabantios daughter) comes into play. He came from a loving mother and father which was mentioned in the importance of the handkerchief In Shakespeares time obedience was though to be one of a womans primary values, and Desdemona thinks herself to be as obedient, but as in the case with her father, she seems to have her own interpretation of what that means. She is beautiful, both in body and spirit. Its not something she mentions, or even seems to be aware of, buy it affects how others treat her and think of her. Desdemona spends much of her time making a case, for herself, for Cassio, and finally for Othello. Iagos devilish character is seen throughout the play. Towards the end of scene two in which Iago brings about Cassios downfall, he persuades Cassio to appeal to Desdemona, and plans to make Othello believe that Caossio and Desdemona are having an affair. Then he says, By the mass, tis morning;Pleasure and action make the hours seem short (2. 3. 378-379). In other words, hes been having so much fun during his busy night, so the time has just flown by. In the last scene of the play, after Iagos treachery has been proven, Othello says to Lodovico, Will you, I pray, demand that demi-devilWhy he hath thus ensnared my soul and body (5. 2. 300-302). Iagos reply is famous. He says, Demand me nothing: what you know, you know:From this time forth I never will speak word. (5. 2. 303-304). Iago is ready and willing to explain himself to Othello,Roderigo, and to us. So then why does he choose to silence himself now Maybe he cant think of another lie. In the characterization of Othello, no one describes him best than his wife and unfortunate victim. In the Venetian Senate, Othello tells the story of how he and Desdemona fell in love. Brabantio urges that Othello used magic and drugs on Desdemona, and that she be brought to testify; he says to her, Do you perceive in all this noble companyWhere most you owe obedience (1. 3. 179-180). In reply, Desdemona affirms her duty to her father, who gave her life and education, but asserts that she has a higher duty to Othello, because he is her husband. She says, My noble father, I do perceive here a divided duty: To you I am bound for life and education; My life and education both do learn me how to respect you; you are the lord of duty; I am hitherto your daughter: but heres my husband, and so much duty as my mother showd to you, preferring you before her father, so much I challenge that I may profess due to the Moor, my lord. (1. 3. 180-189). Further in the act, she says, My hearts subdued even to the very quality of my lord: Saw Othellos visage in his mind, and to his honor and his valiant parts did I my soul and fortunes consecrate. 1. 3. 250-254). Subdued means in harmony with and Othellos quality is both his character and his profession as a warrior. Desdemona asserting that she is very much like her husband and belongs with him, even in war. She shows tat she understands and rejects the bigotry that is directed at him. A persons visage is his face, and she understands that most Europeans consider black to be ugly, but she saw past his face to his honor and courage, which she adores. Her charter is well described here as beautiful both inside and out.

According to Schlossen, this has been accomplished by the fast food industry. Schlosser uses the case study of Plauen, a city in what Schlosser refers to as â€Å"new Germany,† to illustrate the point. Schlosser portrays the McDonald’s in this city as a kind of bright spot in a city that is otherwise depressed, with high unemployment and men desperate for work. Schlosser ends the story of Plauen by describing a bar that opened in that city that has a country-western feel to it, and this, implies Schlosser, defines Plauen today. The dream that Plauen h as now comes not from the circumstances of Plauen itself, because the town is depressed, but, rather, by the shining example of McDonald’s, which fills the hearts of the Plauen people with hope of a better future, a future that is similar to the American Dream. And this is all because, implies Schlosser, Plauen has been supplied this American Dream through the presence of the first American fast food restaurant, McDonald’s (Schlosser, 2001, p. 252). Schlosser also uses the example of Dachau, which has a McDonald’s close to the notorious concentration camp. Just like in Plauen, the McDonald’s in Dachau was filled with people with Americanized clothes, eating Americanized burgers (Schlosser, 2001, p. 232). While this might seem to some to be insensitive to the history of Dachau, in that McDonald’s appears to be crassly commercialized and capitalizing on a tragedy by luring visitors to the ghastly Dachau site to its restaurant, it can be seen in anoth er way. And that is that McDonald’s is merely performing a service for the visitors of Dachau, in that the people who visit the site need to eat, so McDonald’s is simply making doing so convenient. Nevertheless, because the people in the Dachau McDonald’s are Americanized with their clothing and so forth, Schlosser sees this as another example of Americanization in Germany, made all the more insidious because the McDonald’s is capitalizing on a particularly horrible part of German history. There are also health concerns, and there are cultural values and beliefs that we should be free of pathogens, and that the government should do a good job of inspecting our food to make sure that we are not exposed. I went through Norwich University’s website and liked it. I read through course-lists and any pertinent information on offer. We has humans don’t understand the importance of preserving things, we are so focused on who has more than the other or who is worth more than the other that it never dawns on us that one day humans can be a thing of the past. Looking at the most important things of life now with is preserving and growth of things we are currently involved in. Keeping the world a better place to live in so that we are in a good environment to continue preserving the things we need. Why should humans be concerned with the extinction rate? We should be concerned with the extinction and try and preserve the biomes and ecosystems that are present. Over time the ecosystem and biomes have evolved changed in some form or fashion that will leave us in difference from this particular time now. It’s important to have something to be able to look back on for information and or instructions on how to change things that we as human may make a mistake and mess up.

Reading About The Freedom Writers English Language Essay When someone thinks of freedom writers, they instantly think of the movie that was made in 2007. Most people dont even know that the movie was based on a true story. In the 1990s, a new schoolteacher by the name of Erin Gruwell decided that her curriculum needed to be changed. Erin wanted to inspire low-achieving students. Instead of teaching the students about subjects that they dont care about, she handed out journals and asked the students to write about their own lives and the struggles they have been through. Erin knew that all the students didnt like her and she wanted to not only be a teacher, but to be a friend to her students. Making a connection to her students was hard, but she knew that something would be able to get to them, and that was to connect her work to the lives of the students. Stories and plays such as Shakespeares Romeo and Juliet and Anne Frank were presented within the classroom. The students could relate to these stories because just like in Romeo and Julie t, there were gangs. In Anne Frank, there was racism and death. After reading about The Freedom Writers, to words that stand out to me are racism, gang violence and struggles during school and at home. At the time, education was strict because that was the only way to succeed in life. A quote that was stated by one of the writers says, Ive lost many friends, friends who have died in an undeclared war. By analyzing this quote, I feel as if this writer is talking about their experience with gang violence. Because of gang violence, most, if not all, of the writers have to have their guards up. They never know when a gun rampage might begin. Most of the writers were already in a gang because they had no choice. They didnt know what was right from wrong and even their families were in gangs. If they didnt have family, they would go into a gang and make a family. Being in a gang has affected teens way of learning while in school. Their focus is not on school work. Gangs also caused more racism during school. In most of the classrooms, the students were all separated into their racial groups. These groups affected the way the students felt because if they werent a certain type of race, then they werent allowed in. This made it hard for students to ask for help in classrooms because they were in a different group. After reading through the diaries, anyone can understand why and how the writers have overcome their obstacles. To succeed in life, they had to be more open minded and not judge people without knowing them. Its crazy to read the diaries and see how difficult it was to live in a life where you could only talk to people that were in your group, or judging people who I dont even know just because they are different. When someone thinks they have an awful life now, itd good to look back on how the lives of the writers were because it helps us realize that we actually do have a great life and we should be grateful for all of the opportunities we get to take. Being able to go to school, get an education and have friends of many racial groups is an honor. One of the most interesting stories that involved the Freedom Writers was The Diary of Anne Frank. This story was introduced to the writers in the classroom to help them realize that there is someone out there who has it just as bad as they do. Anne Frank had to deal with the Holocaust which was when Germany killed pretty much all of the Jews. Anne Frank fortunately made it out alive because Miep Gies helped hide Anne Frank. Miep Gies actually got out alive as well and was able to write about her experience in the Concentration Camps. The writers were so interested in this book that they just had to meet Miep Gies. They actually raised money and worked together and in the end, they get to meet Miep Gies. Her story touched the hearts of the students and that moment changed their lives forever. Statistics say that during this time, most if not all of the students did pass high school and even move on to college. They honestly didnt think that they would be able to pass because no one believed in them, until Mrs. Gruwell came to teach their classes. I dont blame the students either. Imagine being in a poor neighborhood where all around you are gangs and every night you cant sleep because you hear gun shots. Your family never graduated from school or maybe you have no family to look up to. How in the world could anyone believe in themselves when no one around them cared enough to help them? The Freedom Writers, in my opinion, is probably one of the greatest stories in human history. It not only tells people a little bit about the Holocaust and how it affected many people, but it also lets people know that there are people out there who are suffering and we dont even realize it. I know for certain that most people dont even go in a down town area because they know that there are trashy and poor people who live there. They dont even get the chance to let those types of people explain their story and how they ended up there. Most teens dont have the ability to get a good education like most upper classmen do. After reading about and even watching the movie about the Freedom Writers, it has shown me that people need to give other people a break and not judge anyone just by looking at them. Since the Freedom Writers actually happened, most of us are accepting people of other races and more people are getting educations. In our society, we cant get anywhere without an educati on. From personal experience, The Freedom Writers is actually an inspiring story for young people like me. This story is being read in classrooms all around the world still today. The journals that were written by the students in the classroom, was actually made into a book and is inspiring people all around the world to do better for themselves and for others. After the story of the Freedom Writers leaked out, a foundation called The Freedom Writers Foundation was formed. Its a non-profit organization that was created to inspire young, underprivileged students to pick up books instead of guns and knives. One of my favorite quotes from The Freedom Writers was, When you die, do you think its going to matter if you were a gangster? If you had swag? If you dressed a certain way? Youre dead and youre going to rot. And when you rot, no one is going to remember you because all you left behind in this world was something no one cares about. This quote was stated by Erin Gruwell and this quote should be said to every student thats in school. A lot of people act or dress a certain way to become popular or to stand out, but thats not going to get them anywhere in the world. No one cares how good you look in the real world; its how good you handle situations that are thrown at you.
